CUSCAL “Make a wish…” Promotion

Information on how to enter the promotion forms part of these Terms and Conditions of entry. Acceptance of a prize is deemed acceptance of these Terms and Conditions.

A. Definitions & Terms For the purposes of these Terms and Conditions: “Credit Union” means a Qualifying Credit Union. “Eligible Credit Union VISA Account Holders” means Credit Union VISA Account Holders who: (a) are natural persons and do not include companies or other corporate entities;

• are the person or persons liable to make payments under a Credit Union VISA Account; hold a VISA account with a Credit Union that has elected to participate in the promotion; and have a residential or principal address in Australia (other than Norfolk Island, Christmas Island or the Cocos Keeling Islands), but does not include: Credit Union VISA Account Holders whose Credit Union VISA Account is more than 30 days in arrears (i.e. payment of the minimum monthly balance due on the Credit Union VISA Account is more than 30 days overdue) as at the date of the prize draw or within 5 working days thereafter; if a purchase is made with a lost, stolen or out of order card, or on an account that is overdrawn without a pre-arranged line of credit, that purchase will be excluded in determining how much the cardholder has spent; persons under the age of 18 years as at the date of the prize draw;
• the employees of the Promoter and employees of agents of the Promoter, including Mike Da Silva & Associates (Aust) Pty Limited, and their immediate families; the employees of Credit Unions who are directly involved in the development or implementation of the Promotion and their immediate families.

“Promoter” means Credit Union Services Corporation ( Australia) Limited (CUSCAL)
(ABN 95 087 822 455) of 1 Margaret Street, Sydney, New South Wales, Australia , 2000, contactable on (02) 8299 9000 or on FREECALL 1800 118 555. “Promotion” means the CUSCAL “Make a wish…” Promotion as described in these terms and conditions. “Qualifying Credit Union” means those credit unions that are listed in a schedule to these terms and conditions of use and which can be obtained from the Promoter upon request. “Qualifying Transaction for Weekly Prize Draw Competition” means a transaction, which is:

• debited to a Credit Union VISA credit account in Australia by pressing the ‘credit’ button at the merchant payment terminal; t ransacted to the Credit Union VISA account during the Weekly Draw Period; not reversed or cancelled within 5 days of being posted to the Credit Union VISA account; and
• not cash advances, account charges, BPAY transactions, government fees or ATM transactions.

“Qualifying Transaction for Major Prize Draw Competition” means a transaction, which is:

• debited to a Credit Union VISA credit account in Australia by pressing the ‘credit’ button at the merchant payment terminal; transacted to the Credit Union VISA account during the Monthly Draw Period; not reversed or cancelled within 7 days of being posted to the Credit Union VISA account; and
• not cash advances, account charges, BPAY transactions, government fees or ATM transactions.

“Weekly Prize Draw Period” means those periods as set out in Clause 4. “Major Prize Draw Period” means those periods as set out in Clause 13. B. Promotion 1. The Promotion will commence on 12.00am EDST 04 April 2023 and close at 11.59pm EDST on 26 June 2023 (“Promotion Period”). All times hereafter are expressed as Eastern Daylight Savings Time. 2. There will be two separate components to this promotion. One being the Weekly Prize Draw Competition (Part C) and the second being the Monthly Prize Draw Competition (Part D).

The Weekly Prize Draw Competition

• Subject to clause 16, each Eligible Credit Union VISA Account Holder will automatically receive one entry in the Weekly Prize Draw, for every Qualifying Transaction for Weekly Prize Draw Competition made with their VISA Card during the corresponding Weekly Prize Draw Period.

• There will be twelve Weekly Prize Draws:

  In each Weekly Prize Draw the first Eligible VISA Account Holder drawn will win the prize of $500.00, distributed to the winning Eligible Credit Union Visa Account Holder in the form of a cheque.

• Weekly Prize Draws will be drawn at 12 noon at Mike Da Silva & Associates (Aust) Pty Limited, 15 Grosvenor Street Neutral Bay NSW 2089 on the following dates:

• The first Eligible Credit Union VISA Account Holder entry drawn, in each Weekly Prize Draw, will be declared a winner. Winners, in each Weekly Prize Draw, will be notified by telephone and mail and published in The Australian newspaper on 28 April 2023 (Draw 1 & 2), 12 May 2023 (Draw 3 & 4), 26 May 2023 (Draw 5 & 6), 9 June 2023 (Draw 7 & 8), 23 June 2023 (Draw 9 & 10) and 7 July 2023 (Draw 11 & 12).

D. The Monthly Prize Draw Competition

• Subject to clause 16, each Eligible Credit Union VISA Account Holder will automatically receive one entry in the Major Prize Draw, for every Qualifying Transaction for Major Prize Draw Competition made with their VISA Card during the corresponding Monthly Prize Draw Period.
• There will be three Monthly Prize Draws:

In each Monthly Prize Draw the first Eligible VISA Account Holder drawn will win the prize of $5000.00 distributed to the winning Eligible Credit Union Visa Account Holder in the form of a cheque.

• The Winners of the Major Prize Draws will be drawn at Mike Da Silva & Associates (Aust) Pty Limited, 15 Grosvenor Street Neutral Bay NSW 2089 at 12 noon on the following dates:

• Winners in the Major Prize draws will be contacted by mail and their names will be published in The Australian newspaper on 26 May 2023 (Draw 1), 23 June 2023 (Draw 2) and 21 July 2023 (Draw 3).

E. General Conditions

• The total prize value for the Promotion, at the date of publication of these Terms and Conditions is up to $21,000. If the Prize is subject to any tax, a Winner is liable for payment of such tax. Independent financial advice should be sought. The Promoter reserves the right to redraw in the event of an entrant being unable to satisfy these Terms and Conditions or forfeiting or not claiming a prize. If a Weekly or Monthly Prize remains unclaimed 3 months after the draw, a second chance draw will be held at 12 noon at Mike Da Silva & Associates (Aust) Pty Limited, 15 Grosvenor Street Neutral Bay NSW 2089 on 28 October 2005, subject to any direction given under applicable law, including those given under Reg 37 of the Lottery and Gaming Regulations 1993 (SA). Any second chance draw winners will be notified by mail and their names will be published in The Australian newspaper on 4 November 2005. All Prizes cannot be exchanged, transferred, redeemed for cash or altered. Qualifying Credit Union VISA Cardholders will only receive an entry in the relevant draw if their Credit VISA Card Issuer has agreed to participate in the Promotion. The Promoter will not be responsible for any Credit Union VISA Card Issuer’s decision not to participate in the Promotion. Qualifying Credit Union VISA Card Issuers, at the time of publication of these Terms and Conditions are listed in a schedule to these terms and conditions of use, such a schedule can be obtained from the Promoter upon request. The name, suburb, state and photograph of the winners may be used for promotional purposes by The Promoter, unless a winner otherwise notifies The Promoter at the time of accepting their prize. The Promoter warrants that the prize details are correct at the time of publication of these Terms and Conditions. The Promoter will not be responsible for prizes that are delayed, lost in transit or misdirected mail or any other communication. To the extent permissible by law, Promotion entrants and Winners release the Promoter, its agents, and VISA Card Issuers, from any causes of action, loss, liability, damage, expense (including any claim for legal expenses), cost or charge sustained or in any way incurred, by such entrants or Winners as a result of: any failure or delay by the Promoter, its agents, or VISA Card Issuer which is due to an act of God, riots, acts of terrorism, storms, fire, any labour or industrial dispute, any strike, and other acts which are not reasonably within the control of the Promoter, its agents or VISA Card Issuer; or any failure by computer hardware or software to function correctly in relation to all calculations and functions in the electronic drawing (if any) of winners; or any loss or damage whatsoever which is suffered in connection with the Promotion or the prize/s.
• In the event of any dispute, the decision of the Promoter is final and no correspondence will be entered into, subject to relevant State legislation.

Privacy Notice

• During the course of the Promotion, the Promoter may collect personal information in relation to Qualifying VISA Cardholders and Winners. The personal information which may be collected by the Promoter includes the names and addresses, and in the case of Winners, photographs as well. The personal information will be collected by the Promoter from the records kept by VISA Card Issuers, and in the case of Winners, personally from such Winners. The personal information collected by the Promoter is collected for the purpose of running the Promotion, enabling the Promoter to publish the results of the Promotion, to publicise the Promotion, and to distribute prizes to Winners. Personal information will not be used for any other purpose but for the purpose it is declared to have been collected for. If personal information is not provided to the Promoter, a Winner may forfeit his or her prize, pursuant to these Terms and Conditions.
